Queda derogada aix\u00ed la vella Llei 57\/1968, de 27 de juliol, reiteradament incomplida i diversament interpretada.<\/p>\n<p style=\"text-align: justify\">La nova Llei de\u00a0 20\/2015, de 14 de juliol, d&#8217;Ordenaci\u00f3, Supervisi\u00f3 i Solv\u00e8ncia de les Entitats Asseguradores i Re-asseguradores en la seva disposici\u00f3 final tercera, modifica la disposici\u00f3 addicional primera de la Llei d&#8217;Ordenaci\u00f3 de l&#8217;Edificaci\u00f3. La nova regulaci\u00f3 pret\u00e9n garantir les quantitats entregades a compte, mitjan\u00e7ant contracte d&#8217;asseguran\u00e7a de cauci\u00f3 subscrit amb entitats asseguradores degudament autoritzades a operar a Espanya.<\/p>\n<p style=\"text-align: justify\">Preveu la devoluci\u00f3 de les quantitats avan\u00e7ades entregades pels adquirents i degudament justificades, m\u00e9s els interessos legals. Per al cas que la construcci\u00f3 no s&#8217;inici\u00ef o no arribi a bon port en el termini convingut per a l&#8217;entrega de l&#8217;habitatge, excepte pr\u00f2rroga atorgada pel comprador,<\/p>\n<p style=\"text-align: justify\">Aquesta obligaci\u00f3 naix des del mateix moment en qu\u00e8 s&#8217;obt\u00e9 la llic\u00e8ncia d&#8217;edificaci\u00f3<\/p>\n<p style=\"text-align: justify\">El promotor haur\u00e0 de publicitar l&#8217;exist\u00e8ncia d&#8217;aquesta garantia i l&#8217;asseguradora escollida.<\/p>\n<p style=\"text-align: justify\">Ser\u00e0 prenedor de l&#8217;asseguran\u00e7a el promotor, i assegurat el comprador, sempre mitjan\u00e7ant assegurances individuals en les quals s&#8217;identifiqui exactament l&#8217;immoble adquirit.<\/p>\n<p style=\"text-align: justify\">La p\u00f2lissa d&#8217;asseguran\u00e7a es cancel\u00b7lar\u00e0&lt;, en tot cas, quan s&#8217;expedeixi la c\u00e8dula d&#8217;habitabilitat i la llic\u00e8ncia de primera ocupaci\u00f3, un cop acreditada pel promotor l&#8217;entrega de l&#8217;habitatge.<\/p>\n<p style=\"text-align: justify\">Tamb\u00e9 podr\u00e0 fer-se mitjan\u00e7ant entitats de cr\u00e8dit en les quals s&#8217;hi hauran de dipositar en compte especial, amb separaci\u00f3 de qualsevol altra classe de fons pertanyents al promotor, incl\u00f2s el suposat de comunitats de propietaris o societat cooperativa, i de les que \u00fanicament podr\u00e0 disposar per a les atencions derivades de la construcci\u00f3 dels habitatges.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La nova regulaci\u00f3 de l&#8217;asseguran\u00e7a de quantitats avan\u00e7ades en la construcci\u00f3 i venda d&#8217;habitatges Des de l&#8217;1 de gener d&#8217;aquest any una nova regulaci\u00f3 estableix com a obligaci\u00f3 dels promotors que pretenguin cobrar del comprador d&#8217;un habitatge quantitats avan\u00e7ades abans que s&#8217;entregui l&#8217;habitatge, garantir aquests avan\u00e7aments.
